Game Theory Even Playing Roles in Judicial Situations

Although we do not accurately calculate each individual’s payoff whenever we make choices, the concept of game theory can be applied to our everyday lives. For the cases covered during the class, we determined the best strategy under the certain circumstance. In reality, however, we have to make a series of choices to ultimately reach the desiring goal. The article categories the gems into finite and infinite games. Chess was mentioned as the example of a finite game. After making predictions of other player’s possible moves, each player determines his or her moves. Aggregation of these distinct choices, the game will ultimately result in one winner and one loser. Culture or religion, on the other hand, is not finite but rather infinite. People do not choose a certain culture or religion in order to win over something. Culture or religion is more related to the evolutionary game theory since it continuously changes according to individuals’ preferences. With this distinction between finite and infinite games, Rajeev explains the status quo in India in which numerous cases are pending in the Indian courts.

Most cases dealt at the Indian courts are under religious or political nature. As mentioned above, religious or political issues are largely subject to infinite games. Since there is a conflict between judiciaries playing finite games and litigants playing infinite games, the party that pursues finite games will be overwhelmed by the resources provided by the opposite party and eventually end up by delaying the case. Rajeev considers this disparity as the root cause of the current judicial situation in India. Therefore, in order to put an end to these incidents of postponing the cases, he believes it is important for the judiciaries to frame questions that will lead toward the finite game. Rajeev does not elaborate further on this point, but in the place where someone’s misdeed is evaluated, concrete pieces of evidence are more helpful than a general statement that does not clearly distinguish the right side and the wrong side.
